Court denies stay for condemned Georgia killer

ATLANTA, Georgia (AP) -- The Georgia Supreme Court on Tuesday denied William Earl Lynd's request for a stay of execution, paving the way for him to become the first inmate in the nation to face execution since the U.S. Supreme Court ruled that lethal injection is constitutional.

Lynd's attorney plans to appeal immediately to the U.S. Supreme Court.

If that fails, Lynd is scheduled to be put to death at 7 p.m. ET Tuesday.

Lynd is on death watch at the Georgia Diagnostic and Classification Prison in Jackson, meaning he is under constant supervision from at least two guards, according to state Department of Corrections protocol.

Lynd would be the first prisoner executed since September, when the high court took up a challenge to lethal injection and effectively halted all executions nationwide for seven months. More>>>
